Prof. Dr. Dr. h.c. Michael Kubiciel is the Chairholder of the Chair of German, European and International Criminal Law, Criminal Procedure Law, Medical and Business Criminal Law, and Director of the Institute for Comprehensive Criminal Law Studies at the University of Augsburg. His research focuses on the foundations of criminal law as well as on the Special Part of criminal law.

He regularly contributes to academic and legal?policy debates and also publishes in national media outlets.

Current Debates on Freedom of Expression and § 188 of the Criminal Code

In recent days, Prof. Kubiciel has engaged in an in depth examination of freedom of expression and its limits under criminal law. The occasion for this were recent decisions of the Federal Constitutional Court as well as the public debate surrounding Section 188 of the German Criminal Code. This provision does not constitute a special privilege for public officeholders; rather, its application presupposes that elected officials must tolerate significantly more intense criticism than other individuals and applies only under narrowly defined statutory conditions.
On these issues, Prof. Kubiciel has contributed articles to FAZ Einspruch and participated in discussions with the ARD justice correspondents. In addition, he was invited to an exchange with a working group of legal policymakers in the German Bundestag.

Academic Exchange at the Universities of Buenos Aires and San Andrés

The visit from 3–10 February 2026 to the Universidad de Buenos Aires and the Universidad de San Andrés offered valuable academic insights and perspectives. Warm thanks go to Prof. Dr. Marcelo Lerman, whom Prof. Kubiciel first met twenty years ago during his master’s studies in Regensburg, as well as to Prof. Dr. Raúl Begeluin. The latter, together with Dr. Leandro Dias, produced the Spanish translation of the habilitation thesis four years ago.
The academic dialogue in Buenos Aires was both intellectually enriching and personally very pleasant – an inspiring exchange that further deepened the existing scholarly cooperation.
Special thanks are extended to the travel companion and co presenter, Prof. Dr. Michael Tsambikakis.
